Leon Smith v. Whitson’s Food Services Corp.

7/14/2026 – Mr. Smith alleged that consumed tainted food, supplied by Whitson’s Food Services Corp., caused him to develop acute pancreatitis. At the close of discovery, we successfully moved for summary judgment, proving that Whitson’s Food did not supply tainted food. It was established that plaintiff’s allegations were purely speculative without any proof that Whitson’s Food meal caused the condition he was subsequently diagnosed with. In granting our motion, the Court agreed that controlling precedent required dismissal of plaintiff’s complaint due to the speculative nature of plaintiff’s allegations.
