Damarr-Faruq v. City of Pleasantville Police Department., et al.

On August 11, 2019, plaintiff alleges that the Pleasantville Police Department utilized excessive force when arresting her and violated her Constitutional and Civil Rights while she was a visitor of Tennessee Green Apartments in Atlantic City. Plaintiff filed suit against our client, RPM Management, who was the property manager for the premises where her assault occurred. Plaintiff alleged claims against RPM Management for general negligence, negligent supervision and failure to train, negligent infliction of emotional distress, and a violation of New Jersey’s Law Against Discrimination (“LAD”). We filed a motion for summary judgment arguing that RPM did not breach any duty owed to plaintiff nor were RPM’s actions the proximate cause of plaintiff’s injuries. District Court Judge Karen Williams agreed and dismissed plaintiff’s complaint and all cross-claims against RPM with prejudice.
