DISMISSAL – MERCER COUNTY SUPERIOR COURT

4/26/19 – Carmella C. Minelli and Anthony Minelli v. Harrah’s Resort Atlantic City

Plaintiff claimed that she sustained serious personal injuries on June 2, 2013, as a result of tripping and falling while walking near the valet area at Harrah’s Atlantic City. Prior to filing an answer and the completion of discovery, Reena Shah filed a motion to dismiss due to plaintiff’s failure to file her complaint within New Jersey’s two year statute of limitations. Plaintiff’s counsel opposed the motion arguing that they are entitled to equitable tolling of the statute of limitations. Judge Anklowitz agreed with our arguments and granted our motion which dismissed plaintiff’s complaint with prejudice.
