4/04/18 Joshua Walker PR LTD v. BK BEASTS LLC DBA CrossFit Outbreak.

This action was based upon a breach of contract claim from Joshua Walker PR LTD a PR agency with offices in London and New York against BK Beasts LLC dba CrossFit Outbreak, a Brooklyn fitness club. Eric Malinowski successfully moved to dismiss this action against our client, BK Beasts LLC dba CrossFit Outbreak, arguing that the plaintiff was not authorized to conduct business in New York and thus had no standing to bring the action under Business Corporation Law §1312. The Court agreed with Mr. Malinowski and held that the Plaintiff could not proceed with this lawsuit in the State of New York as it was an unauthorized business.
