Marchetti v. Modica
In Marchetti v. Modica plaintiff allegedly tripped over furniture that was partially blocking a walkway on our client’s premises. The furniture had been left on the walkway by a prior tenant of our clients. Plaintiff suffered a fractured hip and died shorlty thereafter. Suzanne Lodge successfully argued that the furniture on which the decedent allegedly fell was open and obvious and not inherently dangerous. Our motion for summary judgment was granted and all claims against our client were dismissed.
