Grullon v. Caesar’s Atlantic City
In Grullon v. Caesar’s Atlantic City, plaintiff alleged he slipped on a wet substance and fell down the escalator stairs at Caesar’s Casino. As a result of his fall, plaintiff sustained a significant knee injury and back injury requiring surgery. Plaintiff also contended that he can no longer work due to his injuries.

At the close of discovery, Reena Shah moved for summary judgment on the basis that Caesar’s did not create or have actual or constructive notice of the wet condition on the escalator. In opposition, plaintiff argued that since the incident was captured on surveillance, Caesars had a reasonable amount of time to observe the condition and remedy it. After lengthy and heated oral argument, Judge Hyland agreed with Ms. Shah and dismissed the case.
