Chauvet v. City of New York
Third-party plaintiff, the City of New York, alleged that our client, a water main and sewer contractor, created a defective condition on the curb of a sidewalk during the course of water line replacement work. The plaintiff, a pedestrian allegedly tripped over the defective curb as she exited a New York City Transit Bus.

Eric Malinowski successfully argued, against the City of New York’s opposition, that although our client performed work at the accident location prior to the accident, this work did not include breaking or cutting the curb.
