Summary Judgment – Essex County Superior Court

12/17/2010
Slater v. Harrah’s Atlantic City
In Slater, plaintiff slipped and fell on the marble floor on the main concourse of Harrah’s Casino. As a result of her fall, she sustained a comminuted fracture of her right shoulder.

At the close of discovery Philip Odett moved for summary judgment arguing that there was no foreign substance on the floor and that there was no expert testimony to establish that the marble floor where plaintiff fell was inherently slippery or dangerous. The trial court agreed and granted Mr. Odett’s motion.
