Porto v. Showboat Atlantic City
In Porto v. Showboat Atlantic City, plaintiff alleged she tripped at the top of an escalator at Showboat Atlantic City and subsequently tumbled down the entire flight of steps. As a result, plaintiff suffered significant lower back and neck injuries. Plaintiff argued there was a gap in between the escalator platform and the first step of the escalator which constituted a hazardous condition and thereby caused her to fall. Philip J. Odett successfully argued Showboat’s summary judgment motion before the Honorable Charles A. Little. At oral argument, Mr. Odett persuaded the court that Showboat Atlantic City was not negligent as the escalator plaintiff allegedly fell down was not defective. Judge Little granted Showboat’s summary judgment motion and dismissed plaintiff’s complaint with prejudice.
