Summary Judgment-Bronx County

Flores v. BAM Produce
In Flores v. BAM Produce, plaintiff, an employee of BAM Produce, was injured after he was struck by a pallet jack on a ramp at Hunts Point Terminal. He sustained a significant injury to his leg requiring surgery. Plaintiff sued our client Hunts Point Market, his employer and the employer of the individual who operated the pallet jack alleging negligence.

At the close of discovery, Andrea Sacco Camacho moved for summary judgment arguing that Hunts Point owed no duty to plaintiff to supervise the work of the plaintiff or the driver of the subject pallet jack that struck the plaintiff. The Court agreed and granted Hunts Point’s motion dismissing the plaintiff’s action and cross claims.
