McGuire v. 3901 Independence Owners
In McGuire v. 3901 Independence Owners et. al., the plaintiff slipped and fell on construction debris under a scaffold located outside an apartment complex which was under renovation. Plaintiff commenced an action against the owner of the building, the general contractor and our client–the company that erected the scaffold.

Upon answering the Complaint, Eric Malinowski immediately moved for Summary Judgment arguing that our client neither created the defective condition nor contracted to maintain the scaffold. The Bronx County Supreme Court agreed and dismissed all claims against our client prior to depositions of any party.
