Sabin v. Atlantic City Showboat, Inc.
In Sabin, the plaintiff was a passenger in a Showboat shuttle bus. An assailant wielding a gun and claiming to have a bomb took control of the bus resulting in an eight-hour stand-off with the Atlantic City police. Plaintiff alleged post traumatic stress disorder as a result of being held hostage.

Since plaintiff’s complaint was filed several days after the expiration of New Jersey’s two-year statute of limitations, Reena Shah filed a motion to dismiss plaintiff’s complaint as time-barred. In opposition, plaintiff asserted that there were exceptional circumstances to equitably toll the statute of limitations, and that since she was a New York resident, New York’s three year statute should apply. Judge Noel Hillman agreed with Ms. Shah’s argument and dismissed planitiff’s complaint.
