Angela Mack v. Harrah’s Casino
In Mack, plaintiff alleged that she was injured when she attempted to lift a safe located on the floor of the closet in her hotel room at Harrah’s. The safe came crashing down on her hand. It came out during discovery that the safe was supposed to be attached to a pedestal but it was not yet done. As a result of the accident, plaintiff sustained a crushing injury to her hand requiring surgery.

At the court mandated non binding arbitration, Colleen McClafferty argued that the plaintiff’s negligence was the sole cause of the accident. The arbitrators agreed and ruled in Harrah’s favor. The case was subsequently dismissed with prejudice by way of a court order confirming the arbitration award of no cause.
