Nadel v. Tom Cat Bakery
Plaintiff, a 26-year old female, was struck by defendant’s delivery van as she crossed Delancy Street in downtown Manhattan. Plaintiff suffered a flail injury to her chest with a collapsed lung, eight rib fractures, a lacerated liver, a fractured orbital and a concussion with severe cognitive deficits. At trial, plaintiff claimed that the driver was negligent in striking her in a crosswalk. Andrea Sacco Camacho argued that plaintiff darted into the roadway following a night of drinking. She further argued that defendant’s driver had the right of way and could not have reasonably avoided the accident. After a three week trial, the jury agreed with Ms. Camacho and returned a defense verdict.
