DEFENSE VERDICT AFFIRMED ON APPEAL – BRONX COUNTY

12/4/2025 – Nancy Rodriguez v. 167, LLC

In this action, plaintiff alleged that she slipped and fell down a flight of stairs in her apartment building due to the existence of a greasy substance. This matter was taken to trial, defended by Andrea Camacho, where a defense verdict was secured. Evidence was obtained refuting plaintiff’s notice allegations as impossible under the particular circumstances of the case. The Bronx County jury unanimously found that the defendant did not maintain the staircase in a negligent manner, thus dismissing plaintiff’s complaint. Thereafter, plaintiff moved to set aside the verdict as against the weight of the evidence, which we successfully opposed. Thereafter, plaintiff perfected an appeal to the Appellate Division, First Department, arguing that the jury verdict was irrational requiring a new trial. We successfully defended against that appeal with the Appellate Division unanimously affirming the trial court’s denial of plaintiff’s motion to set aside the verdict. Prior to trial, plaintiff rejected a seven-figure settlement offer.
